Welcome to Hapii, a delivery service platform connecting vendors and customers through delivery personnel. By using our app, you agree to comply with and be bound by the following terms and conditions, in accordance with the relevant laws of India.

3. Service Description

Hapii is a platform that facilitates the delivery of goods, including food, groceries, medicines, vegetables, fruits, electronics, and clothing, from vendors to customers within a 10 km radius of Kolathur. Our delivery hours are between 7 AM and 10 PM daily.

4. Terms of Use

  • Eligibility: You must be at least 18 years old to use our services. By using the app, you represent and warrant that you have the legal capacity to enter into these terms.
  • Account Registration: Users are required to create an account with accurate and complete information. You are responsible for maintaining the security of your account and for all activities that occur under your account.
  • Prohibited Activities: You agree not to engage in any activities that are unlawful, harmful, or violate these terms, including but not limited to:
    • Misusing the app to disrupt services or interfere with other users.
    • Using the app for fraudulent or illegal transactions.
    • Attempting to gain unauthorized access to the app or its related systems.
    • Uploading or transmitting any malicious code or software.
    • Relevant Laws: Any illegal activities will be dealt with in accordance with the Indian Penal Code (IPC) and the Information Technology Act, 2000.

  • Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the app for personal, non-commercial purposes. This license does not permit you to copy, modify, distribute, sell, or lease any part of our services or included content.
  • Third-Party Content: The app may contain content provided by third parties, including vendors and users. Hapii does not claim ownership of third-party content and is not responsible for its accuracy or legality.
  • Trademarks: The trademarks, logos, and service marks displayed on the app are the property of Hapii or third parties. You are not permitted to use these marks without the prior written consent of Hapii or the respective third party, in accordance with the Trademarks Act, 1999.
  • Copyright Infringement: If you believe that any content on the app infringes your intellectual property rights, please contact us immediately with details of the alleged infringement.

6. User Responsibilities

  • Order Placement: Once an order is placed, it cannot be canceled or modified without our consent.
  • Payment: Payments must be made at the time of order placement through the app. We accept various payment methods, including credit/debit cards, UPI, and digital wallets.
  • Delivery: Hapii will make every effort to deliver your order within the estimated delivery time. However, delays may occur due to factors beyond our control.
  • Product Condition: We are not responsible for any product damage or quality issues arising from the vendor. If you encounter any issues, please contact the vendor directly.

7. Vendor Responsibilities

  • Product Listing: Vendors are responsible for providing accurate product descriptions, prices, and availability. Vendors must also comply with the Consumer Protection Act, 2019, ensuring that all product listings and transactions meet legal standards.
  • Order Fulfillment: Vendors must ensure that orders are fulfilled promptly and accurately.
  • Compliance: Vendors must comply with all applicable laws and regulations, including:
    • Food Safety and Standards Act, 2006 (for food items)
    • Drugs and Cosmetics Act, 1940 (for medicines)
    • Legal Metrology Act, 2009 (for accurate weights and measures)
    • Consumer Protection Act, 2019 (for all consumer transactions)

8. Delivery Personnel

  • Role: Delivery personnel are independent contractors responsible for picking up and delivering orders. They must comply with relevant traffic laws, including the Motor Vehicles Act, 1988.
  • Conduct: Delivery personnel must maintain professionalism and follow all applicable traffic and safety laws.
  • Liability: Hapii is not responsible for any actions or omissions by delivery personnel.

9. Service Area

Hapii’s delivery services are limited to a 10 km radius from Kolathur. Orders placed outside this area may be canceled.

10. Limitation of Liability

Hapii will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including but not limited to, delays, product defects, or delivery failures. This limitation of liability is in accordance with the Indian Contract Act, 1872.

11. Termination

We reserve the right to terminate or suspend access to our services without prior notice if you breach these terms or engage in unlawful activities, in accordance with the Indian Contract Act, 1872.

12. Governing Law

These terms and conditions are governed by the laws of India. Any disputes arising from or relating to these terms will be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, in accordance with the Code of Civil Procedure, 1908.

13. Amendments

Hapii reserves the right to amend these terms and conditions at any time. Any changes will be effective immediately upon posting on the app or website. It is your responsibility to review these terms periodically for updates. Continued use of our services following the posting of changes will constitute your acceptance of such changes.
